1. Use of Site
By using this website, you agree and accept our terms and conditions of use as listed below.

2. Ordering
Acceptance of an order is conditional on the availability of the products you have ordered. All items are subject to availability. If any of the products you have ordered are unavailable we will inform you immediately and offer an alternative.

Order amendments and cancellations must be made by 6pm the night before delivery date.

We use a secure online order form for all purchases made via the website. All data transmitted via this form including credit card details is 128 bit encrypted to secure transmission.

Payment is by credit card on our website and can be made using Visa or Mastercard.

Your order will be acknowledged immediately by email.  Once your order has been prepared and packed, payment will be processed.  This will be on the morning of delivery day. 

The total price provided upon checkout on the website is an estimate only.  As all fresh fish is prepared to customer specific requirements, the actual weight per fillet (for example) may vary slightly once it is cut.  We will try to ensure the variation does not exceed 15% (higher or lower) than the checkout amount.  

Prices on the website are a guide only.  Market prices can change daily due to the nature of our products.  When we purchase the customer items from the Wholesale Fresh Fish market on the morning of the delivery day, if the price has increased/decreased at the market, this price variation will be passed on to the customer.  Although we will attempt to keep the prices as constant as possible, in some cases the price charged may vary to the price on the website at the time of ordering.

3. Personal Information

In order for us to process your order we collect personally identifiable information relating to you including your name, address, telephone number, email address and credit card details.  We will only use your personal information for the purpose for which you provide it to us including response to enquires, delivering items, processing payments, communication to you with regard to order. We will not pass on any details about you to any person not directly employed by us, unless required to do so by law.

4. Delivery

Your order should reach you in perfect condition. We recommend that you inspect packages at point of delivery. Should you have any problems with your order please contact us as soon as possible by phone on 9528 5625 or email us on info@freshfishonline.com.au

To ensure that products arrive in perfect condition and to ensure quality, orders are delivered in our insulated boxes packed with ice. Packaging conditions are such that contents will remain fresh and at the correct temperature for 12 hours from the time of despatch.

**All frozen goods are frozen at the time of purchase, and should be frozen when delivered to your door.  If the frozen goods purchased are slightly or completely thawed, the goods are still ok to eat but must be eaten within 2-3days when kept refrigerated at your home.  Fresh Fish Online reserves the right and will NOT refund under any circumstances or accept any returned goods that are thawed and have been delivered by our courier service to your address.

Deliveries are made on Tuesdays, Wednesdays, Thursdays and Fridays between 12pm and 6pm (except for Public  Holidays where arrangement details will be posted on the site).  Orders must be placed by 5pm on the day prior to the required delivery day.  Orders are prepared on the day of delivery from products specifically purchased for your order, fresh from the Footscray Wholesale Fish Market that morning.

Minimum order is $40 before delivery charge is applied.

Delivery charges START from $6.20 (incl GST and Fuel Levy) dependant on the area of delivery.  Delivery charges are for one delivery to one Victorian address. Please note that we are unable to specify an exact delivery time. Goods are no longer taken to a central depot and circulated from there.  Our current courier company is yes more expensive but picks up the goods from us and delivers straight to your door.  Risk of damage of goods including deterioration of fresh foods passes to you on delivery of all goods.

IMPORTANT – PERISHABLE ITEMS MUST BE UNPACKED ON RECEIPT AND PLACED IN A REFRIGERATOR IN THE CASE OF FRESH PRODUCE OR THE FREEZER FOR FROZEN PRODUCTS. ALL FRESH PRODUCTS CAN BE FROZEN AND WE RECOMMEND THAT IF YOU PLAN TO FREEZE TO DO SO ON THE DAY OF RECEIPT.

It is your responsibility to check your order carefully on receipt of goods. In the unlikely event of orders being found unsatisfactory, damaged or incomplete, you must contact us immediately, and within 24 hours of receiving your order.

Any special / additional packaging requirements will incur an extra charge.

Authority to Leave

Upon checkout of the website, all customers agree to an "Authority to Leave" meaning your package will be left unattended should you not be home to receive it.  This is why we request you please provide very clear and detailed delivery instructions for our drivers when placing your order.  All orders are packed into insulated boxes in order to maintain the required temperature.

5. Food Safety

Fresh Fish Online complies with all Australian food safety standards.  We internally and externally audit our food safety processes and standards on a regular basis in order to maintain the highest level of food safety.

6.  Limitation Of Liability

Fresh Fish Online maximum liability to you for products purchased from our website shall be limited to the refund of the purchase price you have paid for the products. Fresh Fish Online will not be liable for any property damage, personal injury, loss of use, interruptions of business, loss of profits, or other consequential, indirect, incidental, punitive or special damages, however caused, whether for breach of warranty, contract, tort (including negligence), strict liability or otherwise except which it is unlawful to exclude.
